Facts

On July 31, 1997, plaintiff Harold Henson was employed as a service representative for water products company. Plaintiff was dispatched to set up a bottled water unit at defendant premises. While plaintiff was bent down installing the unit, he felt someone walk behind him. After plaintiff finished installing the water unit, he picked up five gallon of bottled water to put on top of the cooler. As plaintiff stood up holding the gallon of bottled water, he struck his head on a cabinet door which had been opened while he was installing the water unit. There were several workmen and employees on the premises that day, engaged in the processof readying the sales office to open. Plaintiff believes that it was the person who passed him that opened the cabinet door which caused the injury. Plaintiff did not see the face of the person who passed behind him, but believes this person was a man.

The plaintiff suffered dizziness, headaches, heart problems, triple bypass, jaw and ear pain, left arm numbness and three heart attacks.
