Nikki Pooshs sued Phillip Morris USA Inc., Altria Group Inc. and other cigarette manufacturers for allegedly causing her lung cancer.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff blamed her developing lung cancer to defendants for making cigarettes so addicting. Plaintiff had been smoking for 35 years until she was diagnosed with chronic obstructive pulmonary disease in 1989 and periodontal disease a year after. In 2003, she was diagnosed with lung cancer. Plaintiff asserted negligence, products liability, misrepresentation, fraud and deceit, concealment, and several other causes of action.
Result
The jury rendered a defense verdict 12 years after the filing of the lawsuit.
