Facts

A complaint was brought under the National Labor Relations Act against respondents, who operated various hospitals, alleging failure to furnish and failure to execute claims.

Contentions

COMPLAINANT'S CONTENTIONS:
The General Counsel to the National Labor Relations Board contended that respondents violated Section 8(a)(5) and (1) of the Act when it failed/refused to provide information requested by SEIU United Healthcare Workers-West and when it failed/refused to execute a complete written agreement reached between the parties.

RESPONDENTS' CONTENTIONS:
Respondents denied the material allegations and set forth affirmative defenses to the complaint.

Result

The administrative law judge concluded that respondents violated the Act on the failure to execute charge, and recommended that respondents be ordered to cease and desist from violating the Act and to take certain affirmative action designed to effectuate the policies of the Act. The failure to furnish charge was severed, and thus the judge did not decide that claim.
