Plaintiffs filed a putative class action against N-JOY Inc.

Contentions

PLAINTIFFS' CONTENTIONS:
Defendant allegedly violated Florida's unfair trading laws and California's consumer protection and unfair competition laws by misleading consumers, through advertisements, that defendant's e-cigarettes were safer than traditional cigarettes. Plaintiffs moved for class certification.

DEFENDANT'S CONTENTIONS:
Defendants claimed that plaintiffs' damages model failed to calculate damages, warranting denial of class certification. Defendant also claimed plaintiffs lack standing to bring an omissions claim. Moreover, defendant contended that studies demonstrated that e-cigarettes were safer than traditional cigarettes.

Result

The court denied class certification due to an inadequate damages model.
