Facts
On July 3, 1996, plaintiff Paul Anka, a 55-year-old entertainer, lost an upper front crown during a performance at the Bally's Hotel in Las Vegas. The show was cancelled as a result of that incident. The plaintiff alleged that dental malpractice was the reason for the loss of the crown. The plaintiff brought this action against the defendant dentist based on a negligence theory of recovery.

The plaintiff made a C.C.P. º998 settlement demand for $165,000. The defendant made an offer of $10,000, which was later withdrawn.
