Facts

On Oct. 4, 1995, the plaintiff, a 62-year-old man, was traveling in the right lane, when the truck operated by the defendant suddenly turned right from the middle lane, attempting to enter a driveway. The plaintiff claimed that the defendant struck the plaintiff's vehicle. The plaintiff brought this action against the defendants based on a negligence theory of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $60,000. The defendants made a C.C.P. º998 offer of compromise for $5,000.

Injuries

The plaintiff suffered a fractured wrist. Per the defendant, the plaintiff also claimed soft tissue injuries and a hernia.

Other Information

The settlement was reached approximately one year and 11 months after the case was filed. ARBITRATION: An arbitration was held June 26, 1997, before attorney Todd Theodora, resulting in a $21,000 award. Trial de novo by the plaintiff. SETTLEMENT CONFERENCE: A settlement conference was held on March 9, 1998, before the Hon. Michael B. Rutberg, retired, of the Los Angeles Superior Court, resulting in the reported settlement.
