On June 13, 1997, the plaintiff, a 27-year-old law student, was traveling southbound on Saybrook at the uncontrolled intersection of Gayhart in Los Angeles. The defendant was traveling northbound on Saybrook and made a left turn in front of the plaintiff, causing a collision. The collision resulted in the total loss of the plaintiff's vehicle and was of such force that the airbag was deployed. The plaintiff brought this action against the defendant based on a negligence theory of recovery.

Injuries
The plaintiff allegedly sustained cervical, thoracic and lumbar strain and sprain injuries, requiring physical therapy; and a tongue laceration. The plaintiff also claimed left shoulder strain and sprain injuries and underwent an MRI on her left shoulder as a result of her continuing complaints. Despite the essentially negative findings on the MRI study, the plaintiff's doctors recommend she undergo a future left shoulder exploratory arthroscopy for left shoulder traumatic impingement syndrome.
