Facts
On June 14, 1996, plaintiff Trang Kim Phan, a 26-year-old assembly worker, presented to defendant Kien Van Nguyen for acupunture treatment and herbal medication. The plaintiff contended that the defendant applied unknown herbal medications over the plaintiff needle punctures, failed to keep careful medical records, and failed to properly refer the plaintiff to other medical professional in a timely manner. The defendant contended that he was not negligent, and that the plaintiff's injuries were caused by an allergic reaction which the defendant could not have prevented. The plaintiff brought this action against the defendant based on a medical negligence theory of recovery.
