Facts
Plaintiff Glenn Tom, a restaurant owner, worked a second job as a the director of Future Paging & Cellular Inc. (defendant) in San Francisco. There he conducted promotional activities since the 1980s. He worked on the first floor at a Future Paging office that was leased on 651 Kearny Street. On the afternoon of April 14, 2003, the plaintiff went to see his new office located on the second floor. The defendant had contracted Wei Nan Jiang to do remodeling, including work on the stairway. The plaintiff slipped and fell while walking down the stairs and was taken to the hospital.
Damages
The plaintiff claimed $163,000 in past medical costs. He contended an unspecified figure for past and future pain and suffering.
Injuries
The plaintiff sustained acute central cord syndrome secondary to a massive disc rupture at C3-4 and C4-5 and underwent a microdiscectomy. The plaintiff contended he will need further treatment.
Result
The parties settled 30 days before trial, for $415,000 before retired Judge Harry Low; $400,000 of which was from Chung and Future Paging and $15,000 from Jaing.
