Andrew Wong, 35, was shopping at Costco in San Francisco when he was allegedly assaulted by a store loss prevention agent who suspected him of shoplifting. Wong and another suspected shoplifter were detained at the store. At the time of the incident, the plaintiff had been laid off from his employment for approximately one year. Wong sued Costco Wholesale Corporation, Khaled Shehad and Richard Cross, both loss prevention agents. Wong alleged causes of action for assault, battery, false imprisonment and negligent intentional infliction of emotional distress.
