Facts
On Nov. 8, 1996, plaintiff, a 39-year-old warehouseman, was injured on the job. The defendant was working at his employer's warehouse, rehabilitating a cold food storage area. In the process, a forklift carrying a long load in front of it without the assistance of a spotter pinned the plaintiff against a wall, causing injuries. The plaintiff brought this action against the defendant based on negligence.
Damages
The plaintiff claimed $10,938.19 in medical bills and $840 in lost earnings.
Injuries
The plaintiff alleged strain to the right knee, left ankle and left knee. Magnetic resonance imaging showed possible Grade II changes to medial meniscus and a questionable tear to the anterior cruciate ligament.
Other Information
The matter was presented as a mediation to C. David Serena of Judicate West during a settlement day at the defendant's insurance carrier's office. As a result of the mediation in the office and over the phone for a period of two weeks, the matter resolved.
