On May 10, 1996, plaintiff, a 68-year-old grandmother, was a paid guest at defendant's ocean front hotel. The hotel had an outdoor cement walkway with a mild incline consisted of approximately 15 steps. Safety handrailings were in place when the steps were originally built in 1971. The steps had no handrailings on the date plaintiff was walking down the steps, lost her balance, and fell. The plaintiff brought this action against the defendant based on negligence.

Settlement Discussions

The plaintiff made a demand for $18,000 and later made a C.C.P. º998 settlement demand for $75,000. The defendant made no offer.
