Facts

On Feb. 4, 1993, plaintiff a 59-year-old truck driver, was driving on Highway 93 between Kingman and Wickenberg. The defendant's truck was hauling trusses which clipped the plaintiff's truck, causing damage to portions of the cab and the trailer. The plaintiffs brought this action against the defendant based on a negligence theory of recovery. An arbitrator decided the liability issue before trial.
