Facts

Plaintiff Manuel Caraveo, a 54-year-old owner of a home cleaning business, presented to the hospital with complaints of abdominal discomfort and, following conservative therapy, was scheduled for an Endoscopic Retrograde Cholangio Pancreatography (ERCP) procedure. During the procedure, performed by Dr. Ara Tavitian, there was evidence of extravasation of dye into the submucosal space at the opening of the pancreatic duct. The extravasation continued for two frames and then the procedure was terminated. Later that evening, following discharge, the patient developed severe abdominal pain. Upon readmission, it was discovered the patient developed severe necrotizing pancreatitis. Over the next three weeks, the complications of autodigestion included a variety of coagulation disorders and ultimately a massive brain hemorrhage that led to the patient's death. The plaintiffs brought this action against the defendant based on a medical negligence theory of recovery.
