On Jan. 23, 1997, the defendant, backed into plaintiff's, a 27-year-old painter and light construction worker, car. At the time, plaintiff was parked and sitting in his car in the parking lot of a motel. The plaintiff contended that he was injured from the impact. The defendant contended the impact was very minor and did not result in any injury. The plaintiff brought this action against the defendant based on negligence.
