On July 23, 1994, plaintiff Jack Reid, a store manager in his 40's, was operating a forklift manufactured by defendant Big Joe Manufacturing and distributed by defendant Big Joe California in the back room of his supermarket. Part of the load struck overhead pipes and fell, striking him. The plaintiff brought this action against the defendant based on breach of warranty, malice, strict products liability and negligence theories of recovery.
