On June 20, 1996, plaintiff Noel Deleon, a security guard, got stuck in an elevator and broke the lock on the escape hatch to get out. He got on top of the elevator car, made contact with others, and knew help was on the way. However, he stayed on top of the elevator and the elevator started up again. The plaintiff fell and was trapped. The plaintiff brought this action against the defendant based on negligence, product liability and breach of warranty theories of recovery.
