Facts

On July 19, 1997, defendant's 1994 Jaguar XJS automobile collided with a motorcycle being driven by plaintiff with plaintiff No. 2 as passenger, at an intersection. The plaintiffs brought this action against the defendants based on negligence; and assault and battery theories of recovery.
