On May 18, 1995, defendant Dr. Richard T. Koenigsberg, a podiatrist, performed surgery on plaintiff, a 46-year-old engineer, to remove an accessory ossicle and remodel a hypertrophied navicular in plaintiff's foot. The plaintiff brought this action against the defendant based on a medical negligence theory of recovery.

Settlement Discussions

Per defendant, the plaintiff made a settlement demand for $185,000. The defendant made no offer of compromise.

Injuries

The plaintiff claimed he suffered the complete disruption of the posterior tibial tendon requiring extensive corrective surgery.
