Facts
Plaintiff Derrick Satchell and others claimed that defendant FedEx Express Corp. racially discriminated against black and Hispanic employees, in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. 1981 and California Fair Employment and Housing Act. Among other things, according to plaintiffs, defendants utilized a "Basic Skills Test" in determining promotions to certain positions, which unfairly discriminated against black and Hispanic workers. The plaintiffs also alleged discrimination in compensation and discipline.
Result
The defendant agreed to pay close to $55 million to settle the class action. Under the settlement agreement, the defendant must also make policy changes, such as eliminating the basic skills test used in promotions. Further, the defendant agreed to make its performance assessment process less discretionary.
