On December 12, 1988, a truck owned by Defendant Western Waste and operated by their employee (Edgar Guerra) collided with Plaintiffs' house which is located at the bottom of a steep hill, at 1871 Mount Olympus Drive in Los Angeles. The collision caused property damage to the front door area, foyer, garage, and laundry room. Plaintiff Helen Hovsepian was in the shower and did not sustain bodily injury; her son and maid were also in the house, neither sustained bodily injury. Plaintiff Helen Hovsepian was a 39-year-old homemaker and Plaintiff Vahe Hovsepian was a 49-year-old real estate salesman, at the time of the incident. Defendants stipulated to liability.

Settlement Discussions

Defendants contend they offered $50,499 new money ($30,000 previously paid); Plaintiffs' original demand was for $22,000,000 punitive damages; and $750,000 for loss of use; emotional distress; real and personal property damage; and punitive damages; reduced to $175,000 new money on the first day of trial.

Real property damage of $25,000; Italian Cypress trees at the cost of $2,500 each; $55,000 personal property; loss of use; and $350,000 emotional distress.
