On December 27, 1991, Donald Gordon, a 64-year-old male on disability was referred to Defendant F.H.P.'s vascular surgeon (referred by another F.H.P. doctor) regarding a possible angiogram and potential surgery for blockage of the left carotid. The Defendant's surgeon concluded that the angiogram would only be appropriate if the patient quit smoking. The patient called back in a few days and informed the surgeon's office that he had quit smoking. Defendant F.H.P.'s surgeon made one unsuccessful attempt to get back to the patient and made no further attempt at contact or at setting up an angiogram. In June 2, 1992, the Donald Gordon died of an intracranial hemorrhage. Plaintiff was the decedent's widow, Adele.
