Facts

Plaintiff, a 70-year-old property manager driving his automobile, came to a complete stop at a stop sign eastbound on Fairview, at the intersection with Sunset. Seeing no cross traffic, she proceeded into the intersection. Defendant county's sheriff was proceeding northbound on Sunset in a marked patrol car, without red light or siren. He was traveling with rear amber lights activated. The sheriff's vehicle was allegedly traveling at approximately 60 mph at the time that the brakes were applied. The posted speed limit was 40 mph.

Plaintiff contends she demanded $45,000 and Defendant offered $30,000 after the MSC.
