Facts
On April 6, 2000, the plaintiff slipped and fell at a construction site for single family residences located at 1960
East Foothill Blvd. in Glendora. The plaintiff did not know what caused her to fall. The plaintiff was employed
by Real Estate Temps Inc. (not a party to the action) as a real estate sales person. The construction site was
being developed by the defendant, Greystone Homes Inc., as general contractor.
The defendant contracted with the subcontractor, Real Estate Temps, to provide real estate sales personnel at
the construction site. Real Estate Temps provided its employee, the plaintiff, a real estate license. The plaintiff
was showing partially completed residences at the framing/drywall stage at an active construction site to a
prospective buyer and the buyerÆs agent when she fell. The plaintiff had the prospective buyer and her agent
sign a release of liability form which disclosed that there was construction debris on the ground. In addition,
the plaintiff told the prospective buyer to be careful when she walked on account of the construction debris.
Following the plaintiffÆs fall, the plaintiff applied for and received workers compensation
benefits through Real Estate Temps insurance carrier. The plaintiff received, and is still
receiving, workers compensation benefits for her injury.
