Facts
On Oct. 17, 1999, at approximately 10:30 p.m., Culver City police officers were patrolling a high crime area in
the City of Culver City. The officers observed a suspicious vehicle parked in front of a motel with two
individuals inside. They decided to investigate.
The plaintiff, a 40-year-old male, was seated in the front passenger seat. During the
investigation, the plaintiff, who was intoxicated, became verbally abusive towards the officers
and attempted to assault them. The plaintiff was taken into custody at which time he appeared to
be experiencing a seizure. He was taken to the hospital to be treated for the seizure and for the
injuries he claimed to have sustained during the arrest. The plaintiff was criminally prosecuted
for assaulting a police officer and was acquitted.
Settlement Discussions
The plaintiff made a demand of $15,000. At trial, the plaintiff asked the jury to award $50,000 to $75,000.
Injuries
The plaintiff claimed he had suffered a broken foot, injuries to his back, head and neck and bruises all over his body.
