Facts

On Oct. 8, 1995, the plaintiff, a 12-year old male, awakened with extreme pain and swelling in his testicles. He
went with his mother to the emergency room at a major health care facility where he was seen by a physicianÆs
assistant who diagnosed groin strain.
Two days later, the minor plaintiff returned to the health care facility where a diagnosis of
torted testes was made and surgery performed. The plaintiff contended that he had a torted
testicle on Oct. 8, 1995 when he first presented at the health care facilityÆs emergency room. The
defendant contended that the minor had a torted testicle on Oct. 8, 1995 which detorted prior to
Oct. 8, 1995.

Settlement Discussions

The plaintiff submitted a demand of $250,000; the defendant offered $30,000 which was later increased to $50,000.
