Facts
On July 24, 2007, Mark Gregg and Michael Kramer were involved in an altercation where Kramer was cut with a knife. Police and emergency personnel arrived on the property. Gregg began to leave the property as Kramer was receiving medical care. Police officers told Gregg to "drop the knife." One of the officers told another that he was going to shoot. Those two officers fired at Gregg from 50 feet away. Gregg died in the hospital from the gunshot wounds. Gregg's minor daughter, her mother, his mother, and his father brought suit against the city of Los Angeles and the officers for civil rights violations and wrongful death.
Contentions
PLAINTIFFS' CONTENTIONS:
The plaintiffs claimed that the officers used unreasonable force on Gregg. They contended that Gregg posed no imminent threat of death or great bodily injury to anyone at the time of the shooting.
DEFENDANTS' CONTENTIONS:
The defense claimed that the officers had a reasonable belief that Gregg posed an imminent threat of death or great bodily injury to others.
Injuries
Gregg died.
Result
A verdict was returned for the defense.
