Plaintiff Arlich, was trustee of a trust established for the benefit of the wife and daughter of his friend, Dirk Boots. Boots died in 1989. His accountants, defendants Jerry Wolff and Segal, Chadroff & Wolff, prepared and filed the Dirk Boots Estate Federal Estate Tax Return and Fiduciary Income Tax Returns, resulting in overpaid taxes. The plaintiff brought this action against the defendants based on professional negligence to recover the overpaid taxes.
