Facts
On Dec. 28, 1994, plaintiff Lynnett Pairis, a 27-year-old unemployed woman, was injured while fleeing defendant Walgreen Company's store in Oakland with stolen merchandise. The plaintiff was pursued by defendant Walgreen's employee attempting to recover the stolen merchandise. While attempting to apprehend the plaintiff, both the employee and the plaintiff fell through a plate glass window of the store. The plaintiff brought this action against the defendant based on negligent supervision and battery theories of recovery.
