Facts

On Dec. 24, 1996, defendant Louise Broderick guaranteed a loan from the Bank of Coronado to Diagnostic Clinical Laboratories Inc. She met with the bank and separately with the debtor and learned of certain of the debtor's financial problems prior to signing the guaranty. The debtor defaulted on the loan, the bank made demand and Broderick refused to honor the guaranty. The plaintiff brought this action against the defendant based on a breach of guaranty theory of recovery. The defendant filed a cross-complaint for fraud.
