Facts

On March 4, 1994, plaintiff, Kofi Yiadom, a 9-year-old student, was injured while crossing Talbot Avenue in Oakland on his way to Cornell Elementary School. The plaintiff crossed the street outside the crosswalk. The plaintiffs, the child and the mother, brought this action against the defendant bsed on negligence and negligent infliction of emotional distress theories of recovery.

Settlement Discussions

Per defendant, before trial, the plaintiff minor demanded $12,000, and the child's mother demanded $8,000. Further, in closing argument, the plaintiff minor asked for $150,000, and the plaintiff mother asked for $80,000.
