Facts
On Feb. 8, 1996, plaintiff, a 65-year-old woman, was walking down the sidewalk at Lindley Avenue. The plaintiff approached a driveway leading onto the premises of defendant apartment complex managed by defendant property manager, and upon which construction was being performed by defendant construction company. As plaintiff approached the apartment complex, she encountered a truck illegally parked on the sidewalk and obstructing her way. The plaintiff stepped into the street, walked around the truck and prepared to step back onto the curb when she encountered a partially rolled portion of chain link fence lying on the sidewalk. Plaintiff tripped on the chain link fence and fell, sustaining injuries. The plaintiff brought this action against the defendants based on negligence and premises liability.
Settlement Discussions
The plaintiff made a settlement demand for $110,000. The defendants made a total offer of $140,000.
