Facts

On Oct. 20, 1994, plaintiff Darlene Sexton, a 24-year-old cashier, rented a horse from the defendant's stables. She was riding the horse at a walk on the trail which encircled the Los Angeles Equestrian Center when the horse suddenly spooked and began to run. The plaintiff lost her balance and fell from the horse. The plaintiff brought this action against the defendant based on negligence.

The plaintiff made a C.C.P. º998 settlement demand for $25,000. The defendant made a C.C.P. º998 offer of compromise for $5,000.
