On July 17, 1995, plaintiff Debra Shepherd was stopped at a stoplight on Mission Bay Drive prior to the onramp to southbound Interstate 5. The plaintiff was hit from behind by a vehicle driven by the defendant, and the plaintiff's vehicle was caused to strike the vehicle in front of her. The plaintiff brought this action against the defendant based on negligence. The plaintiff contended the accident caused her injury/aggravation of injury. The defendant disputed she was responsible for the plaintiff's injuries and contended her injuries were pre-existing, or were caused by her fall at Home Depot on June 22, 1995.
