Facts
Doe plaintiff sued the Diocese of Stockton, Roman Catholic Bishop of Stockton, Oliver O'Grady and Sacred Heart Parish for sexual abuse perpetrated in the 1980s. O'Grady later admitted to sexually assaulting more than 23 children of both sexes and sleeping with two mothers to get access to their children. Plaintiff was around 11 or 12 when the abuse occurred. His two younger siblings, a sister and a brother, filed similar lawsuits that previously settled for a combined $2 million in damages.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that Sacred Heart should have known that O'Grady was a pedophile. Further, plaintiff claimed that if O'Grady had been removed from priesthood, instead of being shifted from parish to parish, plaintiff would not have been molested.
Result
The parties reached a $1.75 million settlement.
