Facts
Helen Taragan, Frances Taylor, Matthew Wakefield, and Marites Asido filed a class action against Nissan North America Inc. and Nissan Motor Co. Ltd. on behalf of owners and lessees of Nissan and Infiniti vehicles equipped with an electronic "Intelligent Key" system. The system allowed the driver to start the engine wirelessly. Plaintiffs claimed that the system posed a safety hazard because it is possible for the vehicle to roll away after the driver turns off the engine if the automatic transmission is not placed in park. Nissan filed a motion to dismiss for failure to state a claim.
Result
U.S. District Court Judge Saundra Brown Armstrong granted Nissan's motion to dismiss.
