In 2003, 19-year-old Jorge Barrera and Theresa Price were passengers in a 2000 Mitsubishi Lancer. They were at a red traffic light at an intersection in Fresno. A vehicle driven by Helen Bayer rear-ended the Mitsubishi, causing significant damage. Barrera and Price, who both suffered soft-tissue injuries, sued Bayer.

Settlement Discussions

The plaintiffs demanded $5,999.99 (C.C.P. Section 998) which was raised to $22,000 and $21,000 respectively, then reduced to $10,000 per plaintiff. The defendant offered $6,500 to each plaintiff, but withdrew the offer the day before trial.

Injuries

The plaintiffs claimed injuries consisting of soft-tissue neck and back injuries.
