Facts
On March 8, 2002, the plaintiff, 35-year-old Heather Tierney, was driving her 2001 Nissan Quest on V Street in Eureka. Tierney came to a complete stop in traffic. A 1996 Saturn behind her stopped as well, but the vehicle behind it struck the Saturn and caused it to rear-end Tierney's Nissan. The vehicle behind the Saturn was a 1989 Honda Accord driven by Julie Schuyler. Tierney's vehicle suffered minor scratches to the bumper cover. Tierney sued Schuyler, claiming she was driving too fast and too close to the Saturn in front of her.

The plaintiff claimed she suffered from a neck injury which exhibited continuous symptoms limiting her activities and causing depression. In the months after the accident in question, the plaintiff suffered another unrelated accident, underwent a hysterectomy and suffered from mononucleosis.
