The plaintiff, Matthew Lee, a 31-year-old carpenter, was driving through an intersection on a green light, when a taxicab driven by the defendant, Ruben Anthony Zepeda Ochoa, ran a red light and crashed into a third party's vehicle and then into the plaintiff's vehicle. All three vehicles were demolished as a result of the accident. At the time of the accident, Ochoa was working in the course and scope of his employment with defendant Fiesta Holdings Inc.

Injuries
The plaintiff received emergency medical treatment at Coast Plaza Doctor's Hospital for transverse process fractures of the L1 and L4 vertebrae. He was subsequently treated by an orthopedist for broad-based disc bulges at L4-5 and L5-S1, which required three epidural injections. Nine-months after the accident, the plaintiff's MRI revealed a 3 millimeter bulge at the C6-7 disc indenting the thecal sac, resulting in anterior spinal cord contact. The plaintiff underwent a series of three epidural injections to his cervical spine and was being evaluated for spinal fusion surgery when the case was settled.
