The plaintiff, Nicolas Govea, went to see the defendant, Dr. Robert Craig Myers for circumcision for phimosis, a development of scar tissue in the foreskin of the penis and chronic inflammation of the foreskin. In December 2002, Dr. Myers performed a circumcision. Within a month of the surgery, Dr. Myers suffered a massive heart attack and died. Following the circumcision surgery, the plaintiff developed a recurrence of the scar tissue. Upon examination by Dr. Myers's partner, it was discovered that the plaintiff had no skin left on the shaft of his penis. The plaintiff underwent two reconstructive surgeries, the second of which was partially successful. However, the plaintiff was unable to engage in sexual relations.
Settlement Discussions
Nicolas Govea made a C.C.P. Section 998 Offer of $224,999. Rita Govea made a C.C.P. Section 998 Offer of $99,999. The parties participated in mediation, but failed to resolve the matter.
Injuries
Nicolas Govea suffered a severely deformed penis, loss of sexual function, and had to undergo two partially successful reconstructive surgeries. Rita Govea suffered loss of consortium.
