Facts

The defendant, Rodney Rulifson, was a sales representative for plaintiff Southwestern Dirt Exchange Inc. from
1998 to 2001. Southwestern was established by Rulifson's older brother, Michael. Rulifson had authority to
draw checks on Southwestern's bank account in order to pay operating expenses. Rulifson was terminated in
2001 and accused of embezzling funds, fraud, conversion, and breach of fiduciary duty.
Rulifson filed a cross-complaint against Southwestern and his brother Michael for fraud and an accounting.

Damages

The plaintiff claimed $79,257.97 in losses due to the defendant's embezzlement. The plaintiff also requested punitive damages. The defendant requested an accounting of the company's and his brother's finances, as well as compensatory and punitive damages for fraud and costs incurred.
