Plaintiff Holly Smith, 19, was riding in the front passenger seat of her friend's 1994 Ford Escort on Brea Canyon
Road in Brea. The plaintiff's friend lost control of the vehicle, and it careened off an embankment. The car
rolled over and landed in a creek bed. The plaintiff was wearing her shoulder belt, but not the lap belt. She
sustained internal injuries.
Injuries
The plaintiff suffered blunt trauma to her abdomen that resulted in a laceration of her liver. A portion of her liver was removed. She was hospitalized for three months.
Result
The jury returned a verdict for the defendant and awarded it costs and expert witness fees totaling more than $200,000.
