Facts
Plaintiff Muriel Polar, was driving her vehicle in a designated traffic lane in a parking lot of a shopping center in
Camarillo, when defendant Barbara Jean London, driving across designated parking spaces, collided with the
right front corner of her vehicle. At the scene of the accident, Polar reported pain to the front of her left shoulder
and the left side of her neck.
The plaintiff contended that the defendant was negligent, which the defendant did not contest.
Settlement Discussions
The plaintiff made a C.C.P. Section 998 demand of $100,000 (policy limits), which was accepted following the plaintiff's deposition.
Damages
The plaintiff was a massage therapist and was forced to leave her career as a result of her injuries.
Injuries
The plaintiff suffered a shoulder and cervical injury, with accompanying arm numbness. An EMG and nerve conduction revealed left C5, right C8, and T1 nerve root irritation. An MRI revealed protrusions at C4-5, C6- 7, and C3-4. Epidural injections were unsuccessful, but she was not a surgical candidate.
