On Feb. 7, 2001, plaintiff Robert Conklin, a 53-year-old elevator constructor employed by Thyssen Elevator,
injured his back stepping down from a ramp while moving materials at the San Francisco International
Airport. Defendant Tutor-Saliba was the general contractor. In 2003, a jury returned a verdict for Conklin,
awarding $4.3 million in damages. The jury found that Tutor-Saliba provided the ramp, which was defective. It
assigned 87.5 percent of the negligence to Tutor-Saliba and 12.5 percent to Thyssen. Tutor-Saliba appealed.
The First District Court of Appeals affirmed the jury verdict.
