Facts

In March 2003, plaintiff Kia Ross was manager of defendant Cathy Jeans, Inc.'s Del Amo store. In the seventh
month of her first pregnancy, she was demoted from store manager to sales clerk. In February 2003, the
plaintiff was 11 weeks pregnant when she was demoted from sales audit department supervisor to data entry
clerk.

Settlement Discussions

The plaintiff demanded $650,000 plus attorney's fees. The plaintiff's C.C.P. Section 998 offer was for $165,000. The defendant's C.C.P. Section 998 offer was for $40,000.

Damages

The plaintiff obtained psychological counseling after the 2003 demotion and medical attention in 2004 in connection with her miscarriage. She claimed lost earnings and benefits, future lost earnings, emotional distress, and attorney's fees.
