Facts

The plaintiff, a 36-year-old former employee of the defendant county, alleged that from Christmas 1992 to _____________, while working at the defendant court, she was the victim of sexual, suggestive and derogatory comments, improper physical sexual contacts, racial harassment, and discrimination by both the defendant Court Administrator and the defendant supervisor, which continued through the term of her employment. The plaintiff alleged that she reported the harassment to her immediate supervisor, wrote a report and brought the matter to the attention of the Assistant Court Administrator, who did not report the harassment. In the Fall of 1993, the defendant County transferred the plaintiff to another job at another court more than an hour from the plaintiff's home. The plaintiff alleged that while working at this location she was once again subjected to sexual, suggestive and derogatory comments, improper physical sexual contacts, racial harassment, and discrimination by the defendant supervisor, including being provided a photograph of the supervisor's penis, all of which the plaintiff alleged continued through the term of her employment. The plaintiff brought this action against the defendant based on sexual and racial harassment and discrimination, and retaliation theories of recovery.

Settlement Discussions

On August 10, 1995 the plaintiff made C.C.P. º998 settlement demands for $249,999 on the defendant Court Administrator and for $99,999 on the defendant supervisor. On October 6, 1995, the plaintiff made C.C.P. º998 settlement demands for $749,999 each, on the defendant County and on the defendant Municipal Court Judicial Districts. On January 8, 1996 the plaintiff made a C.C.P. º998 settlement demand in the amount of $449,999. The defendants made no offers.
