On October 3, 1989, the decedent, a 63-year-old homemaker, presented to the defendant clinic with complaints of plugged ears, arm and neck pain. (In September of 1989 she had gone to the defendant clinic for various complaints, including shortness of breath. She had also been treated at the defendant clinic for 14 months for hypertension.) On October 3, 1989, the decedent was given a prescription and sent home. The decedent went into a cardiac arrest in the parking lot. Resuscitation was attempted, but the decedent died 13 days later. The plaintiffs, the decedent's husband and children, brought this action against the defendant clinic based on negligence and medical malpractice theories of recovery.
