Facts
On August 4, 1987, the plaintiff, Glen Burnett, a 48-year-old oilfield gauger, was standing on top of an oil production tank at his employer Santa Fe Energy's plant. The plaintiff allegedly opened the tank's hatch and was exposed to fumes, causing him to black out and fall down 12 feet of stairs. The plaintiff claimed the tank contained Magnacide B, a chemical supplied by defendant Baker Performance Chemical, Inc. The plaintiff brought this action against the defendant, Baker Performance Chemical, based on negligence, fraud, and ultra hazardous activity and theories of recovery.
