The defendant was driving his vehicle eastbound on Valley Center Rd, when he made a left turn in front of the plaintiff. The plaintiff, who was traveling 45 mph, was unable to stop in time to avoid the collision. The plaintiff brought this action against the defendant based on negligence theories of recovery.
