On January 19, 1996, the plaintiff, a 22-year-old machinist, was riding his motorcycle eastbound on 101 freeway in Los Angeles. The defendant, driving his/her vehicle eastbound on the 101 freeway. The plaintiff claimed the defendant made an unsafe lane change and caused the collision. The defendant contended the motorcyclist was splitting lanes. The plaintiff motorcyclist brought this action against the defendant driver based on negligence theories of recovery. The plaintiff was scheduled for surgery on May 13, 1996, but was stabbed to to death in a gang attack.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for medicals and loss of earnings only. The defendant made a C.C.P. º998 offer of compromise for $10,053.
